TANZANIA | President Samia Suluhu Hassan’s new special probe team, announced immediately after receiving the Chande Commission report on 23 April 2026, is not a belated move toward accountability. It is a second procedural layer designed to absorb the evidentiary record of approximately 10,000 post-election killings into an indefinite investigative holding pattern; meanwhile, the same pattern of abductions, torture, sexual violence and killings by Watu Wasiojulikana (Swahili: “unknown assailants”) continues in real time. The new body legitimises, rather than interrupts, the operational architecture of Tanzania’s enforced-disappearance campaign.

The Presidential Commission of Inquiry submitted its report to President Samia on 23 April 2026 after 156 days of evidence gathering. Chaired by retired Chief Justice Mohamed Chande Othman, the nine-member body recorded 518 deaths, a figure that sits approximately 95 per cent below the approximately 10,000 killings documented by opposition parties, diaspora forensic teams, and independent international monitors.

More consequential than the casualty arithmetic is what Justice Chande explicitly removed from his mandate. In his own formulation during the inquiry, the commission’s role was not prosecutorial; it existed only to determine who was affected, how, where and why, not who did it. On presenting the report, Chande did not identify anyone responsible for the deaths and recommended further investigations.
This is the procedural fulcrum on which everything else turns. A commission that gathered 63,603 respondents across 21 districts, deployed ballistics experts and geospatial analysts, and sat for 156 days, concluded its work by declining to name a single perpetrator and recommending that a further commission be established. The evidentiary record was not the problem. The refusal to adjudicate it was the design.
What Is the “Commission of Criminal Inquiry” Samia Has Now Announced?
Following receipt of the Chande report, Samia moved to launch a new probe team, the “commission of criminal inquiry” that the Chande panel itself had recommended to determine who should be held accountable.
Three structural features of this new body make its function legible:
First, it investigates the same evidentiary record the Chande Commission already reviewed, but without the 156-day calendar pressure, without the international media attention generated by the original inquiry, and without the Commonwealth monitoring framework that accompanied the first commission’s work.
Second, it operates under the same statutory architecture that gave Samia unilateral authority to withhold documents from publication indefinitely without judicial review or parliamentary notification. The new probe’s findings are, by statutory default, the President’s private property.
Third, and most critically, it investigates events that concluded on or around 29 October 2025, while the perpetrator network under examination continues operating. Tanzania’s enforced-disappearance pattern has not paused during the commission process. It has accelerated.
